Welcome to the Ensinger Alpakas Shop! The terms “we,” “us,” and “our” refer to Ensinger Alpakas GmbH (“Ensinger Alpakas”). Ensinger Alpakas operates this online shop and this website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a personalized shopping experience (the “Services”). The Ensinger Alpakas Shop is powered by Shopify, enabling us to provide the Services to you.

The following terms and conditions, together with the policies referenced herein (these “Terms and Conditions” or “Terms”), describe your rights and obligations when using the Services.

By visiting, interacting with, or using our Services, you express your agreement with these Terms and Conditions and with our Privacy Policy [LINK]. If you do not agree to these Terms and Conditions or the Privacy Policy, you may not use or access our Services.

Section 1 – Access and Account

By agreeing to these Terms and Conditions, you confirm that you are of legal age in your place of residence and that you have given us permission to allow your minor dependents to use the Services on devices you own, have purchased, or administer.

To use the Services, including accessing or browsing our online shop or purchasing products or services we offer, you may be required to provide certain information, such as your email address and billing, payment, and shipping details. You represent and warrant that all information provided is accurate, current, and complete and that you are fully authorized to provide such information.

You are solely responsible for the security of your account login credentials and for all activities that occur under your account. You may not transfer, sell, assign, or license your account to any other person.

Section 2 – Our Products and Services

We have made every effort to display our products and services as accurately as possible in our online shop. However, colors or appearances may vary depending on the device you use to access the shop and its settings or configuration.

We make no warranty that the appearance or quality of products or services you purchase will meet your expectations or match the representations in our online shop.

All product and service descriptions—especially those concerning alpaca products, walks, events, and animal-assisted therapy—may be changed at any time and without notice at our sole discretion. We reserve the right to discontinue products or services at any time and to limit the quantities of products or available spots in events offered to any person, geographic region, or jurisdiction.

Section 3 – Orders

By placing an order, you submit an offer to conclude a purchase contract (for goods) or a service contract (e.g. walks, events, animal-assisted offers). Ensinger Alpakas reserves the right to accept or reject your order at its sole discretion for any reason. Your order is considered accepted only once confirmed by Ensinger Alpakas (e.g. via email). Acceptance requires receipt and processing of your payment.

Please review your order carefully before submission, as cancellation requests after acceptance may not be accommodated unless mandatory legal rights (e.g. right of withdrawal) apply.

If we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, and/or phone number provided at checkout.

Returns or exchanges are governed exclusively by our Right of Withdrawal [LINK] and any additional return instructions in product descriptions or checkout.

You represent and warrant that your purchases are intended for personal or household use and not for commercial resale or export.

Section 4 – Pricing and Billing

Prices, discounts, and promotions may change without notice. The price charged for a product or service is the price in effect at the time of your order and will be listed in your order confirmation email. Unless otherwise stated, all prices are in euros and include applicable VAT. Shipping, handling, customs, or import fees may apply and will be displayed separately during checkout.

Prices in our online shop may differ from prices in physical stores or third-party platforms. Promotional activities may affect pricing and may be subject to terms other than those in these Terms. In case of conflict, the promotional terms take precedence.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You agree to promptly update your account and other details—such as email address, credit card numbers, and expiration dates—so that we can complete your transactions and contact you as needed.

You represent and warrant that:
(i) the payment information you provide is truthful, correct, and complete;
(ii) you are authorized to use the chosen payment method;
(iii) your payment provider will honor the charges you incur; and
(iv) you will pay all charges at the listed prices, including shipping, handling, and applicable taxes.

Section 5 – Shipping and Delivery (Goods)

We ship goods to the delivery address specified during checkout unless otherwise agreed.

We are not responsible for shipping or delivery delays beyond our control. All delivery times are estimates and not guaranteed. We are especially not responsible for delays caused by shipping carriers, customs processing, or events outside our control.

Once we hand products over to the shipping carrier, ownership and risk of loss transfer to you, unless you are a consumer and mandatory law provides otherwise.

Section 6 – Special Terms for Walks, Events, and Other Services

6.1 Subject of the Contract

Through our online shop, you can book services such as:

Alpaca walks
Events and activities with alpacas
animal-assisted offers / animal-assisted therapy (if bookable online)

Specific service details, dates, duration, and pricing are described in the respective service description and your booking confirmation.

6.2 Booking, Participation Requirements, and Animal Welfare

Submitting an online booking constitutes a binding offer to conclude a service contract. The contract is formed upon our booking confirmation.

Animal welfare is our top priority. Participation requirements (e.g. minimum age, physical suitability, group size limits, animal handling guidelines) are specified in the service descriptions and participation instructions.

Dogs
Bringing dogs—regardless of size, behavior, or leash control—is strictly prohibited for all walks, events, and animal-assisted activities, as dogs can significantly stress our alpacas. Participation with a dog is not allowed; no refund will be granted if this rule is violated.

We reserve the right to exclude participants who fail to meet participation requirements or who endanger people or animals. No refund will be provided unless we are responsible for the exclusion.

6.3 Customer Cancellations

The following cancellation conditions apply:

Up to 14 days before the event date: 100% refund
14 to 7 days before the event date: 50% refund
Less than 7 days before or on the event date: no refund

The date of receipt of the cancellation email at info@ensinger-alpakas.de is decisive.

A statutory right of withdrawal generally does not apply to leisure events scheduled for a specific date (§ 312g para. 2 no. 9 BGB).

6.4 Rebooking

Rebooking is possible only by separate arrangement and only within available capacities. There is no entitlement to rebooking. Rebooking made as a gesture of goodwill may incur a reasonable handling fee.

6.5 Cancellations or Changes by Ensinger Alpakas GmbH

Ensinger Alpakas may cancel or postpone services for important reasons, including:

illness, injury, or health restrictions affecting the animals
weather conditions affecting safety or animal welfare (e.g. extreme heat, heavy rain, hail, storms)
official orders or safety risks
staff illness or unavailability
failure to reach minimum participant numbers

If canceled or postponed, we will offer an alternative date. If no alternative is possible or you decline it, payments already made will be fully refunded.

6.6 Vouchers

Vouchers may be redeemed under the conditions listed on them. Cash redemption is excluded unless mandatory law requires otherwise.

Section 7 – Intellectual Property

Our Services—including all trademarks, text, images, graphics, video/audio files, design elements, and their arrangement—are owned by Ensinger Alpakas, its affiliates, or licensors and are protected by national and international intellectual property laws.

These Terms allow use of the Services solely for personal, non-commercial purposes. You may not copy, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material without prior written consent. No provision of these Terms grants you a license or rights to any patents, trademarks, copyrights, or other intellectual property of Ensinger Alpakas, Shopify, or third parties.

Unauthorized use may violate legal protections. All rights not expressly granted remain reserved.

Ensinger Alpakas’ names, logos, product and service names, designs, and slogans are trademarks of Ensinger Alpakas or its affiliates or licensors. Shopify's names and trademarks belong to Shopify. Other names and logos appearing in the Services belong to their respective owners.

Section 8 – Optional Tools

You may access third-party tools provided as part of the Services, which we do not monitor, control, or influence.

You acknowledge that we provide access to such tools “as is” and “as available,” without warranties or endorsements. We disclaim all liability arising from their use.

Your use of optional tools is entirely at your own risk, and you are responsible for reviewing and accepting the terms under which third-party providers offer them.

Any future features, tools, or resources we introduce will also fall under these Terms.

Section 9 – Third-Party Links

The Services may include materials or links to third-party websites. We are not responsible for examining or warranting the content or accuracy of such materials or websites. Access is at your own risk.

We are not liable for damages or losses resulting from your interactions with third-party websites or purchases made through them. Review their policies carefully before engaging in transactions. Complaints or claims about third-party products or services should be directed to the respective provider.

Section 10 – Relationship to Shopify

Ensinger Alpakas is hosted by Shopify as a technical provider enabling the Services. All sales and purchases in our shop are concluded directly between you and Ensinger Alpakas.

You acknowledge that Shopify has no responsibility for any aspect of transactions between you and Ensinger Alpakas. You expressly release Shopify and its affiliates from all liability relating to claims or damages arising from your dealings with Ensinger Alpakas.

Section 11 – Privacy Policy

All personal data collected through the Services is subject to our Privacy Policy [LINK]. Certain data may also be subject to Shopify’s Privacy Policy. By using the Services, you confirm that you have read both policies.

Because the Services are hosted by Shopify, Shopify collects and processes data related to your access and usage to provide and improve the Services. Occasionally, the Services may contain typographical errors, inaccuracies, or omissions relating to product or service descriptions, pricing, promotions, offers, shipping costs, timelines, or availability. We reserve the right to correct such errors and to change or update information or cancel orders at any time without notice (including after order submission).

a) upload viruses or malicious code;
b) copy, sell, or exploit any part of the Services;
c) collect personal data of others;
d) engage in spam, phishing, scraping, or crawling;
e) interfere with or bypass security features.

We may suspend, deactivate, or terminate your account at any time without notice if you violate these Terms.

Section 15 – Termination

We may terminate this agreement or your access to the Services at any time without notice. You remain responsible for all charges accrued up to the date of termination.

Sections concerning intellectual property, feedback, termination, disclaimers, liability, indemnification, severability, waiver, entire agreement, assignment, applicable law, and privacy survive termination.

Section 16 – Disclaimer of Warranties

Information provided through the Services is for general information only. We do not guarantee its accuracy, completeness, or usefulness. Reliance on such information is at your own risk.

Unless explicitly stated by Ensinger Alpakas, the Services and all products and services are provided “as is” and “as available,” without warranties of any kind, expressed or implied, including merchantability, fitness for a particular purpose, durability, title, or non-infringement. Consumer statutory rights remain unaffected.

Section 17 – Limitation of Liability

To the extent permitted by law, Ensinger Alpakas and its partners, directors, officers, employees, affiliates, agents, contractors, service providers, and licensors—as well as Shopify and its affiliates—shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages, including lost profits, revenue, savings, data, or replacement costs arising from your use of the Services.

Mandatory liability (e.g. product liability, injury to life, body, health, intentional or gross negligence) remains unaffected.

Section 18 – Indemnification

You agree to indemnify and hold harmless Ensinger Alpakas, Shopify, and their affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any third-party claims, damages, or liabilities (including attorneys’ fees) arising from:

your breach of these Terms or related documents,
your violation of law or third-party rights, or
your access to or use of the Services,
provided you are responsible for such breach.

Section 19 – Severability

If any provision is found unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted, and the unenforceable portion shall be deemed severed. The remaining terms remain valid.

Section 20 – Waiver; Entire Agreement

Failure to enforce a provision does not constitute a waiver.

These Terms, along with policies published on our website, constitute the entire agreement between you and us, replacing all prior agreements or communications.

Section 21 – Assignment

You may not assign or transfer your rights or obligations without our prior written consent. Any attempt to do so is void.

We may assign these Terms to an affiliate or as part of a corporate restructuring.

Section 22 – Governing Law and Jurisdiction

These Terms and any agreements under which we provide Services are governed by the laws of Germany, excluding the CISG.

If you are a merchant, a legal entity under public law, or lack a general place of jurisdiction in Germany, the place of jurisdiction is our business location, currently [71665 Vaihingen an der Enz / district Ensingen]. Mandatory exclusive jurisdictions remain unaffected.
